DSA of Chile – Legal Update
Recent legal changes in Chile have a direct effect on the social security obligations of independent employees such as the direct selling
sales forces. Law N°20,894, published on January 26th, 2016, has postponed the enforcement of a mandate addressed to independent employees to pay social security contributions and also provides amendments to certain social security regulations that are currently
As part of a large social security reform enacted on 2008, independent employees were required to enroll in the social security system
according to a gradual enforcement process, under which, starting in 2015, independent employees had been required to contribute to a pension fund(AFP), with the option to pay for health insurance. However, considering the low percentage of independent employees
that had fulfilled such obligation to pay social contributions into a pension fund based on 100% of their taxable income, Law N°20,894 has postponed the same until 2018 (tax year 2019). Before such date, independent employees will maintain the right to decide
whether or not to contribute to a pension fund. Likewise, payment of contributions for workers’ compensation insurance and for public and private and health insurance will be mandatory starting in 2018.
Among other important amendments introduced by this law, it is worth noting that collection of outstanding social security payments through
a judicial collection procedure has been eliminated. Instead, the new law indicates that such pending payments will be collected from the amounts withheld by the Chilean IRS in the following tax year.
