Global Regulatory Affairs Committee Update Pon

WFDSA would like to express deepest appreciation to Nathan Moore who served as Chairman of the Global Regulatory Affairs Committee for the past five years.  Due to his new role as President, North America in Mary Kay, Nathan Moore has stepped down as chairman of the GRAC.  WFDSA Chairman DeVos has appointed Pontus Andreasson to succeed him for the remainder of his term.

Nathan commented “I hope all of you know how passionate I am for our awesome industry and the lives we positively change around the world.  I’m extremely proud of our industry and have been fortunate to work with all of you to fight the good fight.  The work we do as employees of DSA members, with the WFDSA and collectively as the GRAC is critical to our industry’s future.  While my new responsibilities will not allow me to continue in my capacity as chair of the GRAC, I rest assured knowing you are in excellent hands under the leadership of Pontus and that you all will press on to protect our industry and companies.”

Pontus Andreasson commented: “It is with great pleasure that I have accepted to take on the role of Chairman of the Global Regulatory Affairs Committee. Our world is constantly evolving, and with this the regulatory environment for direct selling. I hope to continue very much on the path that Nathan Moore has instigated for the Committee, leading its quest to bring relevant support on regulatory trends and development to WFDSAs members around the world.”

Pontus Andreasson is the global head of government and industry relations in Oriflame.

Prior to becoming chairman of the Global Regulatory Affairs committee, Pontus Andreasson has served as part of the chairman’s office of Seldia, the European Direct Selling Association, and at the World Federation of Direct Selling Association (WFDSA) as Association Advisory Council for Europe.

Please welcome Pontus as the new GRAC Chairman

Peruvian Chamber of Direct Selling Update

On November 10, 2016, the Peruvian Chamber of Direct Selling-CAPEVEDI celebrated the first “Direct Selling Day” in Peru.  The event included company executives and direct sellers of the 18 active member companies and one provisional member company.

For Jose Ramon Hernandez, President of CAPEVEDI noted that this event is very important to recognize the achievements of independent sellers. “This is the first time we have held this meeting, and we do it with a lot of affection for the effort and dedication that each of the independent sellers puts in their business every day, since it not only represents results for the associated companies, but for themselves: in the personal, professional and often in the economic “.

Among the benefits, direct selling represents a source of additional income besides what they already perceive as dependent workers, allows them to start their own business with little investment, as well as to improve the quality of life of their families.  At present, seven out of ten are engaged in this type of business, where women and men are found, regardless of their educational background or work experience; and there is a 31% who want to venture into it because of the social and economic impact it entails.

Amcham Vietnam Direct Selling Committee Update

During the two-year period of applying Decree 42/2014/ND-CP on the management of multi-level sale activities which came into effect on July 1, 2014, the Vietnam Regulatory Authority realizes advantages and disadvantages of the Decree 42/2014/ND-CP, and it would like to promulgate a new decree to replace Decree 42/2014/ND-CP.

The new draft decree was provided to Amcham Vietnam Direct Selling Committee (AVDSC) on November 14 in order to collect opinions from relevant competent authorities and multi-level sale enterprises duly operating in Vietnam. There are certain important issues that may affect direct sales in Vietnam.

Particularly, the new draft decree states that: ‘Multi-level sale registration certificate issued under Decree No. 42/2014/ND-CP on the management of multi-level sale activities remain effect until the enterprises are granted with multi-level sale registration certificates under this Decree, but no more than 6 months from the effective date of this Decree’.  This means that multi-level sale enterprises need to re-register their multi-level sale registration certificates within 6 months once this new draft Decree comes into effect. Importantly, multi-level sale enterprises had registered their multi-level sale registration certificates two years ago as required by Decree 42/2014/ND-CP. Now, they, once again, may face the same situation, the same efforts and losses to deal with administrative processes.

The new draft decree also limits compensation plans up to 10 levels and value of commissions, bonuses and other economic benefits for direct marketing activities, sales of multi-level sale participation not less than 50% of the commissions, bonuses and other economic benefits of multi-level sale enterprises. Additionally, the new draft decree requires the enterprises to locate their server in Vietnam for competent authorities to manage detailed information regarding the enterprises’ multi-level sale operations. These requirements cause harsh difficulties to authentic multi-level sale enterprises. In addition, there are certain unclear matters that need further consideration and explanation from the Regulatory Authority.

WFDSA collected input from various DSAs and provided it to AVDSC.  The Global Regulatory Affairs Committee will monitor the situation and provide assistance in regards to the above situation.  AVDSC and direct selling companies operating in Vietnam are currently using their best efforts to explain the enterprises’ positions and negotiate with the Regulatory Authority, including but not limited to asking for further assistance from relevant Embassy/Consulates located in Vietnam.
